1. Scope
These Terms and Conditions, in the version valid at the time of the order, apply to all contracts concluded between us, the Sun Creek Lodge, and the guest regarding the provision of lodge rooms for accommodation as well as all other services provided by the lodge to the guest.
This policy applies to all reservations made through our website https://www.suncreeklodge.bz/, by email, by phone, or in person. Bookings made through third-party platforms are subject to their respective policies.
2. Conclusion of Contract
- The following provisions on the conclusion of contracts apply to orders placed via our website https://www.suncreeklodge.bz/ as well as by other means, such as reservations via phone or email.
- The presentation of accommodations on our website does not constitute a legally binding contractual offer on our part, but is merely a non-binding invitation to the guest to book our accommodation. By booking the desired accommodation, the guest makes a binding offer to conclude a purchase contract.
- The contract is concluded upon acceptance of the guest’s booking request by the Sun Creek Lodge. The Sun Creek Lodge is free to confirm the booking in writing, verbally, by telephone, or by email.
3. Bookings and Services
- Bookings are binding for both parties. The conclusion of a contract obliges the contracting parties to fulfill the contract, regardless of the duration of the contract. The lodge is obliged to keep the accommodations booked by the guest available and to provide the agreed services. The guest is obliged to pay the agreed prices for the provision of the rooms and the additional services utilized by them.
- The check-in time is between 2:00 pm and 8:00 pm.
If you arrive at the lodge before 2:00 pm and your room is not ready, we invite you to relax in our spacious main house with either snacks or drinks, or take a walk to get familiar with your surroundings. We will do everything to have your room ready for you as soon as possible.
- The check-out time is 10:30 am.
If you feel you need to stay in your cabana longer than 10:30 am, feel free to tell us so that we can check whether or not this is possible.
4. Rates and Prices
Rates
All rates are in US Dollars. Accommodations are subject to an additional 9% hotel tax. If more than 2 people occupy the room, there is an additional fee of US $ 20 per person per night. Children under 10 years are free of charge.
Price Guarantee
Accommodation and service prices are based on current rates and are subject to change. The confirmed price at reservation is guaranteed once the deposit is received, excluding surcharges and government tax increases.
Inclusions and Exclusions
Prices include all items and services listed or selected under the accommodation page. Prices do not include international or national air transportation, travel insurance, phone calls, laundry, and personal expenses.
5. Payment Terms
- Payment can be made via credit card (Master, Visa or American Express), bank transfer, or cash.
- Unless agreed otherwise, the guest’s credit card information is required to secure a reservation. We will send a credit card payment form (PDF) with all details to fill out via email.
- If the deposit is not provided within 24 hours of your reservation, the Sun Creek Lodge reserves the right to release your accommodation until payment is made.
- Added charges by your credit card or bank company, which may occur for foreign transactions, are beyond the Sun Creek Lodge’s control. The Sun Creek Lodge cannot be held responsible. We can only account for the amount you have authorized us to charge.
- Refund Process: Refunds will be issued to the original payment method that was used during booking.
6. Guest’s Withdrawal (Cancellation Policy)
At Sun Creek Lodge, we understand that plans can change. Our cancellation policy is designed to be fair and transparent while ensuring that our operations run smoothly. The guest can withdraw from the contract at any time. The cancellation must be made in writing per email to suncreeklodge@gmail.com.
Standard Bookings:
- Free Cancellation Period: Cancellations up to 30 days before the check-in date are free of charge.
- Late Cancellation Fee: Cancellations made less than 30 days before the check-in date will incur a fee of 100% of the total booking amount.
- No-Show & Early Departures Policy: If a guest does not arrive at the check-in date or decides to check out earlier, the full booking amount will be charged.
Group Booking Cancellation:
- Free Cancellation Period: Cancellations up to 45 days before the check-in date are free of charge.
- Late Cancellation Fee & No-Show or Early Departures: Cancellations made after 45 days before check-in, no arrival at the check-in date or early departures will incur a penalty of 100% of the booking amount.
Non-Refundable Bookings:
For reservations marked as “non-refundable”, no refunds will be issued in the event of cancellation, modification, no-show or early departures.
Special Circumstances:
We understand that emergencies can occur. In cases of unforeseen circumstances (e.g. medical emergencies, natural disasters), please contact us directly at phone: +5016076363 or email: suncreeklodge@gmail.com. We may offer flexibility on a case by case basis.
Modification Policy:
Modifications to bookings (e.g. changing dates or room types) are subject to availability and may incur additional charges. Please contact us.
We are not responsible for weather conditions, transportation irregularities or other factors beyond our control.
7. Lodge’s Withdrawal
The lodge is entitled to withdraw from the contract for a justified reason, for example, in the case of force majeure or other circumstances beyond the lodge’s control that make the fulfillment of the contract impossible. The lodge will inform the guest immediately of the exercise of the right of withdrawal.
8. Lodge’s Liability
The lodge is liable for damages that are based on an intentional or grossly negligent breach of duty by the lodge or its vicarious agents. For simple negligence, the lodge is only liable for the breach of essential contractual obligations and limited to the typical, foreseeable damage. The lodge is not liable for items lost or stolen within the lodge premises unless such loss is due to gross negligence by the lodge.
9. Guest’s Liability
The guest is liable for all damages caused by them to the lodge’s building or inventory. This includes damages caused by other guests or third parties who were invited by the guest. The guest is also responsible for ensuring that they and their party comply with all lodge policies, especially those regarding safety and conduct within the lodge and surrounding jungle areas.
10. Policy Modifications
The Lodge reserves the right to modify this policy at any time. Changes will not affect existing reservations.
11. Final Provisions
Changes or additions to the contract, the acceptance of the application, or these terms and conditions should be made in writing. Unilateral changes or additions by the guest are ineffective. The place of fulfillment and payment is the location of the lodge. Only the law of Belize applies.
Should individual provisions of these Terms and Conditions be or become invalid or unenforceable after the conclusion of the contract, the validity of the remaining provisions of the contract remains unaffected. In place of the invalid or unenforceable provision, the valid and enforceable regulation whose effects come closest to the economic objective pursued by the contractual parties with the invalid or unenforceable provision shall apply.
These Terms and Conditions are governed by and construed in accordance with the laws of Belize. Disputes arising from these terms and conditions or the contract will be resolved in the competent courts of Belize.
